No lien shall attach to any personal property left in or out of the vehicle. Personal property shall be given to the current registered owner or the owner's authorized agent upon demand.
The lien holder shall not be responsible for property after any vehicle has been disposed, after the vehicle ownership changes. (Reference Vehicle Code 2551b)
Any person has a lien dependent upon possession for the compensation to which the person is legally entitled...of any vehicle that has been authorized to be removed by a public agency, private property owner, person in lawful possession of the property, or lessee, operator, or registered owner of the vehicle. (Reference Vehicle Code 3068.1)
Although the Vehicle Code is silent regarding storage rates, you should be able to defend the rates you charge. You should document your rates and whether the vehicle is inside or outside, protected or not (in a fence and locked gate or on a vacant lot). Businesses should have a posted rate sign stating the storage costs.
The Vehicle Code is silent about vehicle valuation on storage liens. Vehicle value depends on the make, model, and year manufactured, condition of the vehicle and the location. Although the Kelly Blue Book gives price guides it doesn't cover the difference in locations, as is condition of the vehicle, and other factors that can effect the vehicle's price. We suggest checking your local newspaper.
